Abstract

The recent executive order by President Trump targeting sect. 230(c) of the Communications Decency Act recommends interpreting the clause restrictively, to exclude social networking platforms from benefitting of the so-called Good Samaritan clause. While unlikely to influence the judicial understanding of the scope of application of the provision, the order may nonetheless persuade law-makers to tackle the issue of free speech online in the near future by coordinating with the main stakeholders, i.e. the internet social networking platfoms.
