The Principle of Solidarity and European Environmental Constitutionalism. Germany and Italy in the Anthropocene

Abstract

This contribution outlines the European horizon of environmental constitutionalism, reconstructing the latest constitutional amendment in Italy. It questions the potential impact of the revision, beyond mere greenwashing. The article further explores the controversial notions of sustainability and solidarity, according to the intergenerational perspective adopted by the European Union. Intergenerational solidarity emerges as the basic structure of European environmental constitutionalism, as Article 20a Grundgesetz clearly exemplifies. The analysis of the Italian amendment is therefore conducted through the review of the debate that accompanied its approval and a comparison with the German case.
