The American Compact Theory seems to be suitable to explain some European Staatenverbund’s dynamics. In fact, despite its non-state nature, the European commonwealth still needs to be legitimate by the European Peoples thru the adoption of a federal Constitution. A true European federal Constitution could also avoid the ECJ’s excesses in constitutional transformative rulings. The lack of political constitutionalism in the European Union’s transformations should be reconsidered in the light of a ‘European Compact Theory’. In this different perspective it is better to refer to a lack of ‘constitutionalism by the People(s)’.
