La precettività della CEDAW alla luce delle riserve a carattere religioso: un equilibrio precario
Abstract
Abstract: The enforceability of CEDAW in light of the religious exemptions: an unstable balance – CEDAW is designed to cover all aspects of women’s rights, nevertheless the Convention’s aims seem to be hampered by a huge number of reservations made by several State parties. Above all, some States are concerned about the compatibility between international provisions and religious norms. The authors focus on the effects in national systems of religious exemptions on relevant articles of the Convention and wonder if these reservations may be an insurmountable obstacle to achieve gender equality or if the international legal system will be able to spread its force and overcome the still existing resistances.
