Abstract

Nordic constitutionalism recognizes a key position to Parliament in the constitutional systems of the five Nordic countries and this is reflected in the use of travaux préparatoires as recognized sources of law, because they are a piece of democratic and rationally justifiable legislative procedure. The special position of Parliament in the Nordic systems is also one of the reasons of the deferent judicial respect of the will of the legislator (cautiousness in judicial review of legislation) and the real significance of the preparatory works as a source of law in these countries.
