Public policy and regulation after the Covid-19 emergency. Some reflections on the recent antitrust trends
Abstract
This paper brings a comparative analysis on the assumptions of legitimacy of the regulatory activity by independent administrative bodies. Furthermore, the research focuses on the architecture of state powers in order to distinguish whether and to what extent the political power has opposed the rules produced by independent agencies before and during the Covid-19 pandemic. The objective is therefore twofold: on the one hand, the paper exposes the intrinsic limits of the institutional structure of the agencies and, on the other hand, it describes the trends in the field of policy-making that affect the regulatory activity.
