Abstract

Abstract: The article aims to reflect on the protection of minorities. To this end, the experience of the Bosnia and Herzegovina is analysed as a case study. As is well known, in the 90s the Country was the scene of a terrible conflict. The “Dayton Constitution” of 1995 (that is the Annex 4 of the Peace Agreement) provides for a particular institutional design, finalized to guarantee the equal position of the three «constituent peoples», that fought each other during the war. The article focuses on this solution, that over the time has become a substantially block in the system, because of the complexity of the decision-making procedures, and violates the (political) rights of the minority groups (the “Others”).
