The ECHR System and the national resistances: the case of Swiss referendum

The paper analyses the risks for human rights because of populist attacks. The Swiss referendum aimed at modifying the constitution to place Swiss legislation above international law and could have been the first step towards withdrawing Switzerland from the European Convention on Human Rights. Therefore, the paper underlines the reactions to the rejection of Self-determination Initiative (also known as the “Swiss law, not foreign judges” initiative) by Swiss voters.
