Abstract: Looking for the Fair Balance between Freedom of Contract and Fundamental Rights in the case law of the European Court of Human Rights – It is now widely accepted that the European Convention on Fundamental Rights and Freedoms enjoys an indirect horizontal effect, although the European Court of Human Rights has not yet clearly defined the extent to which the Contracting States have to secure respect for Convention rights in the private law sphere. This article focuses on the Court’s case law touching upon contract law and offers a critical analysis of the puzzling relation between contract and fundamental rights within the framework of ECHR law.
