The instruments of participatory democracy tested by the digital switchover - In accordance with the decision of the Human Rights Committee on the case of Staderini and De Lucia v. Italy, the Italian budget law introduced the electronic collection of signatures necessary for holding referendums. Just a few months before, a constitutional reform was approved in the Chamber at first reading, introducing a new type of popular legislative initiative and eliminating the participatory quorum of the referendum.
Through the comparison with the French, Spanish and European Union legal systems, the essay shows that the participatory democracy system that is taking shape in Italy, while being part of a common framework of digitalization, is not sufficiently balanced and requires urgent corrective measures.
