Abstract

The pandemic management by Germany: “Wir schaffen das!” - Germany’s constitutional and legislative architecture has withstood the pandemic without extraordinary powers. The reaction to the health crisis has been in line with the logic of executive federalism, under critical monitoring of public debate and a functioning judicial system monitoring the impact of restrictive measures on fundamental rights. In reaction to the National Socialist past, the fundamental importance of democratic procedures and respect for guarantees of the rule of law even in times of emergency is unquestioned. The German approach can be defined as attempt to cope with the crisis within the ordinary framework of constitutional, legislative and administrative procedures.
