Abstract

The paper highlights the main pros and cons of the use of AI in the judicial context, taking into account different functions that AI can concretely perform. Technological reliability and constitutional sustainability shall represent key-criteria in order to assessing the impact on both fundamental rights and the judiciary function that the use by judges and other public authorities in the judicial environment can provoke. Special attention is dedicated to the existing case-law and legislations from a comparative perspective, with the aim to provide a first classification of different regulatory approaches to the field.
