Abstract

Flexible right: the right to personal data protection in EU lockdown exit strategy – A new right has been emerging from the collision between fundamental rights generated by the emergency measures to contain the Covid-19 epidemic. This is the right to data protection, which has taken on considerable importance in public health protection strategies, especially with regard to contact tracing measures. Conceived as “flexible”, this right can play a crucial role in ensuring the effectiveness of government measures. Through the analysis of acts and documents of the European institutions, this paper aims to discuss its problematic implications, placing it within the broader framework of EU legal principles.
