Verfassungsbeschwerde and recurso de amparo: what place for the EU Charter of Fundamental Rights? - From the perspective of the multilevel protection of fundamental rights, the equivalence of the EU Charter of Fundamental Rights to the Treaties has posed new coordination problems at the European level. With reference to direct appeals to the Constitutional Courts, the Bundesverfassungsgericht, with the decision Right to be forgotten II (2019) now allows individuals to appeal directly for the violation of the rights established by the Charter. This orientation was not accepted by the Spanish Constitutional Court. This paper, starting from similarities and differences between the German and Spanish models, aims to analyze the existing framework and question the effects that could derive from the consolidation of this diversity of orientation.
