Le ordinanze emergenziali delle autorità locali: riflessioni a margine delle esperienze di Italia e Francia

Abstract

The emergency ordinances of local authorities: some reflections on the experiences of Italy and France – The present contribution dwells on the theme of the emergency ordinances adopted by local authorities in Italy and France to face the sanitary emergency generated by Covid-19. After a brief excursus on both regulatory and jurisprudential profiles of emergency measures in both legal systems, the arguments rendered by the bodies called to express their view on the most "controversial" monocratic provisions adopted at local level are put under investigation. Through the orientations emerged in both legal systems, it was possible to identify the limits – which cannot be crossed not even in such of emergency – to the extra-ordinem power.
