Abstract

This research compares some environmental courts and tribunals (ECTs) - Environment Court of New Zealand, Chinese Environmental Courts, Indian National Green Tribunal and Bolivian Agri-environmental Tribunal - and reveals similarities and differences concerning the authority and impartiality of the judge, the type of actions, the conditions of access, the centralization or decentralization of these system of justice etc. External scientific and technical expertise, low-cost procedure and ethics inspiring judges are also crucial. New environmental courts seem to overcome the secular divide separating civil and criminal jurisdictions and indicate the lack of a dominant model in environmental justice within western legal tradition.
