Abstract: Forty years after the adoption of the CEDAW Convention, what are the achievements? – Having described the social and legal context preceding and contemporary to the CEDAW adoption, the author analyses how the convention has
been applied in the Italian legal system. Once established the ineffectiveness of the International Convention, the study focuses on the cause of this issue by identifying it in the higher greater normative force of the principle enshrined in Article 3 of the Italian Constitution. Moreover, the second major weakness of CEDAW is the absence of the solidarity value between people and between states. Conversely, the Italian Republic can benefits from a developed principle of equality and the principle of social solidarity, which contribute for fundamental rights to be effective. Finally, the author proposes to implement the standards of thew CEDAW by employing the principles of solidarity among States.
