Abstract

Abstract: Implementing CEDAW in the national legal system – Adopted by the UN General Assembly in 1979 and ratified in Italy in 1985, the CEDAW has not succeeded in achieving its aims. Conversely, Articles 2 and 3 of the Constitution, had
characterized by a strong programmatic value, have produce better results in relation to the effectiveness of women's rights. In particular, the principle of equality, interpreted in the sense of anti-subordination and not anti-discrimination, is capable of promoting a new civil culture. Thus, the gap between men and women would gradually be narrowed and a society of truly equal people would be built.
