Abstract: Algorithmic decision making and international perspectives of valorization of human intervention – This contribution investigates the effectiveness as well as the actual and potential role of human intervention in algorithmic decision-making. Moving from an assessment of the ever-increasing power of algorithms, coped with the peculiarities of algorithmic decision making when compared to human reasoning, the analysis focuses on the right not to be subject to a purely automatic algorithmic decision. This right, formally provided in its legal dimension in art. 22 GDPR, is evaluated in terms of effectiveness as well as in its potential evolution beyond its current scope of application as a global standard for algorithmic decision making. A more explicit acknowledgement seems important as a tool to protect human autonomy in the ongoing process of establishment of an international regulatory framework for artificial intelligence.
