The purpose of this essay is to hermeneutically analyze the institution of the temporary absence of the President of the State regulated by Article 169, paragraph II of the Bolivian Constitution—and related provisions— a provision that has given rise to constitutional interpretative disputes due to the issuance of Supreme Decree No. 5515 of December 29, 2025, in a context of disputes between the President and Vice President of the State, which has led to tension within the executive branch and civil society due to the contradiction between the will of the President and the will of the constituent assembly.
