Abstract

Trump v. TikTok Between Freedom of Expression and National Security – This article explores the legal dispute between TikTok and the U.S. government, focusing on the tension between freedom of expression and national security. It analyzes the legislative and judicial developments culminating in the 2024 Act banning foreign adversary-controlled apps. The Supreme Court upheld the law as content-neutral, applying intermediate scrutiny and emphasizing national security concerns over data access and algorithmic control. While the ruling avoids addressing deeper First Amendment implications, it raises questions about government overreach, digital platform regulation, and the balance between security and civil liberties in the digital age.
