Legislative power and constitutional courts before the principle of intergenerational solidarity. Some final considerations – In contemporary legal systems, the enjoyment of a right involves both an active commitment on the part of public authorities and a duty of solidarity, which is projected in both a supranational and intertemporal sphere. In particular, the need to guarantee the life expectancy of “future” generations of citizens put at risk by underdevelopment, climatic, economic, health emergencies, and migratory movements. Finally, for better protection of the interests of “future generations” it seems appropriate to strengthen the institutions of deliberative democracy and to recognize the legitimacy of collective forms of “resistance” in case of serious delays or omissions by public authorities in addressing issues related to intergenerational equity.
Keywords: Constitutional duties; Ecosystem protection and the right of resistance; Fundamental rights protection; Inter-generational solidarity; Participation rights.
