Abstract

European Conditionality and Constitutional Identity. An introduction -This paper introduces the Section on European conditionality and constitutional identities. Firstly, it presents the papers collected in the Section and its structure. In the second part, it briefly describes the multiple conditionality mechanisms in the EU legal system and deepens their relationship with fundamental rights on the one hand, and with the multiple lines of tension within the Union on the other. Finally, the contribution analyses conditional mechanisms from the perspective of public finance law. It is shown how these mechanisms are connected as much with the fundamental principles of the EU legal system as with the financial situation of the Member States.
