Participatory mechanisms and reformist thrusts in environmental protection in Italy and France
Abstract
This article investigates whether the adoption of environmental constitutionalism, both in Italy and in France, has or can still influence participatory models. Starting from the analysis of public debates and public inquiries in both legal systems, this article highlights how the limitations of participation in environmental decision-making still persist, also considering the weaknesses of judicial review.
