Climate change is the failure of progress and anthropocentrism, of the balance between sustainability and profit, and of the relationship between man and nature. This contribution aims to experiment with the use of legislative and jurisdictional instruments “beyond the state” and the categories of statehood, in order to respond rigorously to contemporary challenges in a “global legal space”. After analyzing the recent antithetical comparative experiences of Switzerland and Germany, the aim is to explore the possible developments of climate litigation in the Italian legal system, considering the new Article 9 of the Constitution.
