Climate Constitutionalism. Introductory Remarks

The latest report on climate change from the United Nations’ Intergovernmental Panel on Climate Change (IPCC7GIEC) shows the urgent need for a rational and critical approach toward the issue of constitutional climate change, in order to prevent oversimplification. Despite the alarming data, government policies aimed at fighting climate change remain inadequate. The article is divided into three parts, the first of which considers the question of constitutional climate change and how it relates to comparative constitutional law. The second part discusses the responses of constitutional systems to climate change, including the presence and effectiveness of climate clauses in constitutions, the role of legislation, and the influence of the judiciary. The final section raises questions about the relationship between the climate crisis and the form of the state.
