Abstract

The fight against Covid-19 and the declaration of unconstitutionality of the first state of alarm of 2020 in Spain: on the limitation and suspension of fundamental rights – The purpose of this work is to analyze the declaration of unconstitutionality carried out by the Spanish Constitutional Court of the first state of alarm declared by the Government of Spain in 2020 in order to face the serious consequences derived from the Covid-19 pandemic. The analysis of the corresponding judgment of the Spanish Constitutional Court is of great interest for the purposes of determining the system of limitation and suspension of rights in Spain in extraordinary situations.
