Abstract

The paper focus on the role of the Court of Justice, which has actively contributed to the formation of Union law, creating rules and principles intended to form the foundations of the European Union system and therefore positioning itself fully alongside the three "legislative" institutions (Commission, Council and European Parliament). 
Three hypotheses in which the Court has been confronted with a dynamic reading of the conventional text are particularly noteworthy: fundamental rights, principles and competences. In more recent times, it is also important to mention the pronouncements concerning the protection of new categories of rights, inter-institutional relations and the safeguarding of the rule of law.
