The Confederate monuments between law, history, and memory – The essay deals with the American debate about the monuments and the statues dedicated to the Confederacy. In the first part, the paper contextualizes the Confederate
monuments within the American history and the legacy of the Civil War. In the second part, it describes the pro-removal paradigm, that uses the Government Speech Doctrine to support the removal of these monuments. In the third part, it explains the propreservation paradigm, aimed at preserving monuments and statues, thanks to cultural heritage law. After having delineated pros and cons of each framework, the essay in the fourth part proposes the pro-management paradigm, inspired to the principles of transitional justice law.
