Abstract

The dialectic between constitutional justice and political powers: Latin American experiences – The dialectic between constitutional justice bodies - constitutional courts and tribunals, supreme courts - and political powers follows trajectories strictly conditioned by the type of form of government and political regime. The autonomy and independence of constitutional and supreme courts are frequently subjected to pressures and limitations, which sometimes result in the establishment of impeachment procedures against their members. The Inter-American Court of Human Rights monitors these phenomena where they result in the violation of human rights consecrated by the San Jose Convention of Costa Rica of 1969, but does not seem capable of operating as a tool for the effective implementation of democratization processes within member States.
