Abstract

Brief Note on the German ‘Federal Emergency Brake’ – A number of questions have been raised about the validity of the so-called 'federal emergency brake'. Although its implementation expired in June 2021 and the German Federal Court established the constitutionality of the imposed restriction, it is a crucial precedent in assessing the present strain of German federalism. This comment focuses on the constitutional shortcomings of the emergency brake with regards to cooperative mechanisms between levels of government.
