Abstract

This article aims to examine the transatlantic approaches to the platform governance of online speech. The primary objective is to highlight the constitutional reasons why the two Union and the United Stated have followed two divergent paths to address the role of platforms in moderating online content. The first part of this article describes the origins of the private government of online speech. The second part examines the consolidation of the rule of platforms. The third part provides the comparative analysis looking at how Europe and the United States addressing the challenges of the private governance of online speech.
