Administrative simplification in the United States of America between transparency and participation - Administrative simplification in the United States of America is particularly interesting from a comparative perspective, due to the specificities of the administrative models. The enormous growth of administrative agencies and the consequent increase in the regulatory power of the administration have determined the need to simplify administrative procedures. In the general law on administrative procedure – the Administrative Procedure Act (APA) – the procedures based on transparency and participation are used in both decision-making processes –rulemaking and adjudication – in order to determine a very broad involvement of citizens in the regulatory function. After the Presidency of Trump, who wanted to ‘deconstruct’ the public administration, the new President Biden must also face a very important challenge. In this particular period of health emergency, he must rethink a new model of the public administration that gives priority to simplification and participation and is consistent with the tradition of American constitutionalism.
