According to the sixth chapter of the report of the Commission on the UK’s Future - Renewing the Purpose of the United Kingdom – the United Kingdom is witnessing a constitutional moment, due to the economic crisis and the loss of the trust of the people in democracy, requiring a wide constitutional reform. To this aim, the Brown commission suggests the adoption of a new constitutional statute – based on a strict pre-legislative scrutiny – introducing inter alia a catalogue of social rights. This paper provides for a comment of the proposed constitutional statute, with particular reference to some problematic issues concerning the sources of the UK political constitution and the effectiveness of social rights.
