The dialogue between environmental conditionality, constitutional safeguards and economic freedoms in the scenario of the natural and climate crisis
Abstract
The European Union is paying greater attention to the need to protect natural resources and the environment : this can be noticed also looking at the widespread use of the conditionality mechanism , through which financial assistance has been often linked to the respect of some relevant requirements related to the safeguard of the environment . Constitutional law in EU countries embraces similar concerns , as demonstrated by the inclusion in several Fundamental Charters of
specific provisions which underline the relevance of environmental ist concerns and reinforce the discourses on a correspondent adjustment of economic freedoms. Considering the need for a radical transformation of our society and its customs in order to face the challenges of the ecological crisis , this contribution examines the role of the environmental conditionality as a tool to hasten the reduction of harmful practices , lastly highlighting the perspective of a more ambitious coordination between supranational policies and the constitutional structures of each State
