Il Tribunal Constitucional si pronuncia sulla Ley Orgánica de Amnistía: qualche considerazione sulla sentenza destinata a concludere il procés indipendentista catalano

This paper examines the Spanish Constitutional Court’s judgment No. 137/2025, which declared the constitutionality of the Catalan amnesty law. It reconstructs the political and constitutional background of the procés and the legislative genesis and substance of the Ley Orgánica 1/2024, through which the clemency measure was introduced. Finally, it analyzes the Court’s reasoning on the general admissibility of amnesty within the 1978 Constitution. The study concludes with critical observations on the actual capacity of the law, though declared constitutional, to achieve the proposed goal of reconciliation.
