Ecological transition and special courts: comparative considerations between Sweden and India
Abstract
The role of the Courts has become extremely relevant in accelerating the achievement of ecological transition goals while ensuring that fundamental rights are not violated. In response to these growing needs, a model of "mixed" environmental courts has emerged, embodied and manifested by its equal composition of judicial members and experts in scientific and technological disciplines (engineers, geologists). As a result, this study examines two legal experiences from Sweden and India that, while distinct and distant, are linked by a common and convergent model of a special environmental Court.
