Constitutional powers facing brexit: UKSC fixes the limits
Abstract
Abstract: The “Miller” judgment of the Supreme Court of the United Kingdom clarifies some crucial aspects of the brexit issue, putting the limits among the powers of the constitutional bodies. On the one hand, it confirms the active role of the Parliament invoking article 50 of the TEU, judging as compulsory the statute authorizing the government to trigger it; on the other hand, it excludes that the devolved assemblies can legislate on this matter. A complex and deep judgment, among the most important ever issued by this Court.
