Migration policies, security and rights: a comparison between Italy and France - The article conducts a comparative analysis of the reforms implemented in Italy and France to combat illegal immigration, focusing on their impact on human rights. The paper will take its start from the legislative data, recently reformed both in Italy with the “decreto Cutro” of 2023 and in France with the “loi Darmanin” of 2024, then it will focus on the critical profiles that seem to emerge. A critical examination is undertaken to illuminate emergent issues of pertinence, chiefly those relating to administrative detention and the decisions taken by administrative entities in removal procedures.
