State aid in times of crisis: obsolete prohibition or undue flexibility? – The past fifteen years have witnessed various emergencies – economic, health, and war – impacting the EU economy similarly. This contribution examines the genesis of these crises and the Commission’s decisions on competition and aid, emphasizing the increasing use of aid exemptions, raising questions about the continued relevance of Article 107 TFEU’s prohibition. Additionally, the EU General Court’s growing annulments of Commission decisions on aid measures prompt a need for stricter ex ante controls or a reevaluation of the entire framework. Lastly, the need for a unified taxation system, crucial for fair crisis management, remains a low priority for the Union.
