The parameters of constitutional justice in environmental matters: comparison between Italy and Germany

Abstract

The protection of the environment is a relevant issue in the global public debate. Both the Italian and German Constitutional Courts play significant roles in the development and application of principles aimed at ensuring adequate protection of the environment as an asset for future generations. This paper will examine and compare the parameters used by the respective constitutional Courts, also based on European legislation, and ask whether new instruments of protection are needed.
