The definition of Essential Performance Levels between old and new grey areas: what effects on the constitutionally necessary equalization? - Starting from the framework law for the implementation of differentiated autonomy no. 86/2024, as well as from the recent ruling of the Constitutional Court no. 192/2024 regarding the same, the paper intends to investigate the many causes (or grey areas) which, for over twenty years, have prevented the implementation of the main instruments constitutionally envisaged to safeguard financial solidarity in the context of Italian regionalism, represented by Essential Performance Levels (EPLs). Trying to understand what consequences this non-implementation has caused on the front of state equalization intervention in support of territories with lower fiscal capacity, the contribution finally tries to question the likely future that awaits the new EPLs, especially in light of the decades-long experience of the Essential Levels of Assistance (ELAs).
