Abstract

Some remarks on the legitimacy and consensus of constitutional and supreme courts in their recent relationship with public opinion – The article aims to address the criticism raised against constitutional and supreme courts in recent years because of their proactive institutional communication. It addresses the latest developments in institutional communication of courts, arguing that the strategies and means of communication that courts have developed recently cannot be simply explained as the consequences of technological developments in communication or as the pursuit of political consent. Conversely, they should be related to countering populist narratives and promoting a constitutional culture, as those purposes are narrowly intertwined with the role of courts and judicial review of legislation.
