A methodological proposal for a first approach to a constitutional-comparative study of Latin America

Abstract

The aim of the following paper is to outline a methodological approach that may be useful in dealing with Latin American legal systems and the numerous difficulties that arise in comparative studies on Latin America. To this end, starting from the common features that characterise the legal systems of this sub-region, we will reconstruct, focusing exclusively on their peculiarities, the fundamental characteristics that certain “legal facts” assume in this area, specifically the form of government, the type of State, the catalogue of rights and constitutional justice.
