The Author questions the tightness of the constitutional rules in the context of Ukrainian belligerence: Articles 11 and 78 Const. She observes that the action in Ukraine, although it is war, has neither been called by its name nor treated as such, while the fundamental right to peace has the flavor of an unconditional rush to war due to the inconclusiveness and pretense of peace negotiations. The author concludes by reflecting on the risks that unjustified derogations from the constitutional framework could pose to the restoration of the previous legality once the emergency is over. How then to react to the danger that an 'anomalous normality' may establish itself?
