The precautionary principle: the problematic relationship between law and scientific uncertainty

Abstract

The work analyses the precautionary principle and its consequences within our system. The principle is analysed from the point of view of the production of technical legislation and, more specifically, from the point of view of the evaluation of the legislation by the common and constitutional judge, also based on the latest procedural changes made by the Constitutional Court. Finally, the work tries to demonstrate how the problematic relationship between law and uncertain science can be solved by regulating the procedures that introduce scientific knowledge, also before the Constitutional Court.
