The asymmetry of the Derechos Estatutarios in the Spanish legal system between identity, non-discrimination principle, and federal and regional perspectives on the Estado Autonomico

Abstract: The second generation statutes of autonomy have introduced derechos estatutarios (regional rights) into the Spanish legal system. In this field, while the Comunidad autónomas (Regions) have proposed a federal and identity-based perspective on the Spanish state of autonomies, the Constitutional Court has affirmed a regional and egalitarian idea of what Spanish federalism is. In this framework, the paper aims to explore these two different perspectives on Spanish federalism, analysing them according to the federalist theory of subnational constitutionalism and asymmetry in fundamental rights protection.
