The blocking of the swift payment system and the ‘boomerang’ effect of increased cryptocurrency transactions in the Russian-Ukrainian conflict

Abstract

The paper takes as its starting point the economic sanction adopted by the EU against Russia for the war it declared on Ukraine, which led to the former's exclusion from the SWIFT payment system, and examines, in particular, one of its most critical consequences represented by the increase in cryptocurrency transactions. The characteristics of a multiform phenomenon of controversial legal regulation are highlighted, which is affirmed - also in the light of certain important interventions of the European legislator - as ontologically refractory to an effective and complete regulation due to its highly technological connotation and incessant innovation.
