Abstract

The Role of Public Prosecution in Argentina's Legal System - The author starts by describing the constitutional and legal frame in which Argentina's Public Prosecution Service operates, the hierarchy and relationships between its members, and the system of recruitment and control of prosecutors. After detailing the general functioning of the Public Prosecution Service, the essay goes into the various options individual prosecutors have in order to exercise their powers, the different ways in which criminal proceedings may start in accordance to the offence indicted, and the new tools Argentina's Federal Code of Criminal Procedure incorporates so as to advance and regulate prosecutorial discretion. The article ends with some considerations about the unsteady relationship between the Public Prosecution Service and the press regarding political uproars and controversial cases.
