The relationship between memory and criminal law

The paper explores the relation between memory and criminal law because of in the last few years the denial or the distortion of the facts of the Holocaust is increasing. The Author analyzes, in particular, the French case starting from the loi Gayssot. It further focuses on some critical aspects of the Council framework decision 2008/913/JHA adopted for combating certain forms and expressions of racism and xenophobia by means of criminal law.
